1. Acceptance of Terms

By accessing or using Lustmate ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any such modifications.

2. Eligibility

You must be at least 18 years of age to use Lustmate. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Lustmate contains adult content and is not intended for minors. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content & Conduct

You retain ownership of any content you create or upload to the Service, including character descriptions, conversation prompts, and other user-generated material ("User Content"). By submitting User Content, you grant Lustmate a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content and agree that it will not violate any applicable law or infringe upon the rights of any third party.

5. AI-Generated Content

The Service uses artificial intelligence to generate text, images, and voice responses ("AI Content"). AI Content is generated algorithmically and does not represent the views or opinions of Lustmate. AI Content may be inaccurate, inappropriate, or otherwise unsuitable. You acknowledge that AI Content is provided "as is" and that Lustmate makes no warranties regarding its accuracy, completeness, or fitness for any particular purpose.

All AI-generated images depict fictional characters and are not representations of real persons. No actual human beings are depicted in any AI-generated visual content.

6. Intellectual Property

The Service, including its design, logos, software, and proprietary technology, is owned by Lustmate and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent. Character templates and system prompts provided by Lustmate remain our intellectual property.

7. Subscriptions & Payments

Lustmate offers subscription plans that provide access to premium features. Subscriptions are billed on a recurring basis (monthly or annually) and will automatically renew unless cancelled before the end of the current billing period. All payments are processed through CCBill, our third-party payment processor. Prices are subject to change with reasonable notice. Refunds are handled in accordance with our refund policy and applicable law.

8. LustCoins

LustCoins are a virtual currency used within the Service to access certain features such as image generation and premium AI interactions. LustCoins have no cash value, are non-transferable, and cannot be redeemed for real currency. Unused LustCoins are non-refundable. We reserve the right to modify the pricing and availability of LustCoins at any time. LustCoins may expire if your account is terminated or after a period of inactivity as specified in our policies.

9. Prohibited Uses

You agree not to use the Service for any of the following purposes:

• Creating, soliciting, or distributing content involving minors in any sexual, exploitative, or inappropriate context
• Generating content that promotes, depicts, or facilitates illegal activities
• Harassing, threatening, or intimidating other users or any individual
• Impersonating real persons, including public figures, without their consent
• Attempting to circumvent content moderation systems or safety filters
• Using the Service to generate spam, malware, or phishing content
• Reselling, sublicensing, or commercially redistributing AI-generated content without authorization
• Attempting to extract, reverse engineer, or replicate the Service's AI models or algorithms

10. Content Moderation

Lustmate employs automated systems and human review to moderate content on the platform. We reserve the right to remove, restrict, or flag any content that violates these Terms or our Community Guidelines. Content moderation decisions are made at our sole discretion. Users may report content that they believe violates our policies, and we will review such reports in a timely manner.

11. Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through your account settings. We may retain certain data as required by law or for legitimate business purposes following termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUSTMATE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUSTMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE. IN NO EVENT SHALL LUSTMATE'S AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID LUSTMATE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Creator Economy

Lustmate allows eligible users ("Creators") to create and publish AI characters and earn revenue based on user engagement with their characters. Participation in the Creator Program is subject to the following terms:

• Revenue Share: Creators receive 30% of net revenue generated by their characters through subscriptions, LustCoin purchases, and tips attributable to their content. Revenue share percentages are subject to change with 30 days' notice.
• Payouts: Earnings are paid weekly via the Creator's chosen payout method (bank transfer or cryptocurrency), subject to a minimum payout threshold of $5.00. Lustmate reserves the right to withhold payouts pending investigation of suspicious activity.
• Content Ownership: Creators retain ownership of their original character descriptions, backstories, and creative elements. By publishing characters on Lustmate, Creators grant us a non-exclusive license to display and distribute their content within the Service.
• Compliance: Creators are responsible for ensuring their characters comply with all applicable laws and our content guidelines. Characters that violate our policies may be removed without notice, and associated earnings may be forfeited.

15. DMCA / Copyright Policy

Lustmate respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, please provide our designated agent with a written notification containing:

• A physical or electronic signature of the copyright owner or authorized agent
• A description of the copyrighted work that you claim has been infringed
• A description of where the allegedly infringing material is located on the Service
• Your contact information (address, phone number, email)
• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf

DMCA notices should be sent to: dmca@lustmate.ai. Repeat infringers will have their accounts terminated.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in the State of Delaware.
